The World Anti-Doping Code (2021) includes a substance on the prohibited list if it meets at least two of the following: (1) it has the potential to enhance or enhances sport performance; (2) it represents an actual or potential health risk to the athlete; (3) it violates the spirit of sport. This paper uses a case study to illustrate points of tension between this code and enhancements that are appropriate to ban; we argue that there are banned drugs (e.g., acetazolamide (...) and dexamethasone) the use of which we have good reason to not only permit but encourage for high-altitude sports. Drawing on lessons from this case study, we propose a reformulation of the Code that requires (1–3) be met but offers preferable ways of unpacking conditions (1) and (3) – and in a way that better preserves how the spirit of sport condition should be indexed to particular sports. Our formulation is inclusive enough to rule in drugs like acetazolamide and dexamethasone as permissible in high-altitude sports while at the same time ruling out problem cases – including many drugs already on the prohibited list. The result is an attempted alignment between the conditions specified and those drugs that should be banned. (shrink)

This paper develops a synthesis of three basic societal dimensions. These three qualify as basic dimensions by virtue of being collectively inclusive, mutually exclusive to a higher degree than any alternative dimensions we have explored, and universally applicable, i.e., to all social situations. We take the six transact dimensions to be such a set. Of these six we here develop a synthesis of three (acts, people, and time) which we take to be most basic, not in the sense of relative (...) importance to human life and welfare, but in the sense of being completely mutually exclusive, of being explicitly as well as implicitly necessary in the modelling of a very large proportion of social situations, and of being not at all elusive when observed as here in all-or-none units for the acts, “noses counted” for the people, and discrete units of time. For these reasons we consider this set of dimensions especially suitable for first attempts at synthesized rational and predictive models (as distinct from purely analytical, empirical and descriptive models). It is anticipated, however, that as initial efforts increase our scientific skill, essentially the same modelbuilding techniques will be applicable when the “trickiest” or most compounded of the transact dimensions, namely values and circumstances, are also dealt with. This paper argues that a consideration of the problem of providing truthmakers for negative truths undermines truthmaker theory. Truthmaker theorists are presented with an uncomfortable dilemma. Either they must take up the challenge of providing truthmakers for negative truths, or else they must explain why negative truths are exceptions to the principle that every truth must have a truthmaker. The first horn is unattractive since the prospects of providing truthmakers for negative truths do not look good neither absences, nor totality (...) states of affairs, nor Graham Priest and J.C. Beall’s ‘polarities’ (Beall, 2000; Priest, 2000) are up to the job. The second horn, meanwhile, is problematic because restricting the truthmaker principle to atomic truths, or weakening it to the thesis that truth supervenes on being, undercuts truthmaker theory’s original motivation. The paper ends by arguing that truthmaker theory is, in any case, an under-motivated doctrine because the groundedness of truth can be explained without appeal to the truthmaker principle. This leaves us free to give the ommonsensical and deflationary explanation of negative truths that common-sense suggests. (shrink)

It is now some thirty years since the researches of John H. Fisher and Malcolm Richardson highlighted the importance of the records of the central government in the process of English-language “vernacularization” in early-fifteenth-century England. Their publication of the Anthology of Chancery English provided irrefutable evidence of a linguistic transition that overtook some key types of government records, which began to be drafted in English where previously they had been written in Anglo-Norman French and, to a lesser extent, Latin. But (...) while the existence of these early examples of “official” written English cannot be doubted, the forces that underlay this linguistic shift are less clear. From the very outset, doubts were expressed about the hypothesis advanced by Fisher and Richardson, that the spread of English in the records of the central government could be directly attributed to a “language policy” put into place by the Lancastrian regime and, in particular, to the personal initiative of Henry V, who made the momentous decision—from a linguistic point of view—to have his signet letters written in English rather than French in July 1417. But it is only more recently that a more detailed and robust criticism has been directed toward these ideas. In an article published in 2004, Michael Benskin rightly pointed out that the very term “Chancery English,” or “Chancery Standard,” as applied in the work of Fisher and Richardson is a misnomer, since only a minority of the documents contained within the Anthology were actually produced within the Chancery itself. He also questioned the extent to which the Chancery could be credited with an enlightened attitude toward written English, given that some of its most prestigious records—the close, patent, and statute rolls—continued to be written in Latin or French throughout the fifteenth century. It has recently been suggested that the type/token theorist concerning musical works cannot come up with an adequate semantic theory of those sentences in which we purport to talk about such works. Specifically, it has been claimed that, since types are abstract entities, a type/token theorist can only account for the truth of sentences such as “The 1812 Overture is very loud” and “Bach's Two Part Invention in C has an F-sharp in its fourth measure” by adopting an untenable semantic (...) claim: namely, that the predicates in such sentences, once applied to musical works, undergo a systematic shift in their meanings. This article is a sustained explanation of why our talk about musical works in fact provides no problem for the type/token theorist. First, we demonstrate that the aforementioned “meaning shift” approach to the sentences’ predicates is well motivated and very credible. Second, we explain how the type/token theorist can adopt the best available version of an alternative, generic quantificational approach to such sentences. Third, we establish that other semantic theories, presented as undermining the type/token theory by giving us a reason for adopting eliminativism about types, are much less theoretically virtuous than the two theories that a type/token theorist can freely adopt. If one flips an unbiased coin a million times, there are 2 1,000,000 series of possible heads/tails sequences, any one of which might be the sequence that obtains, and each of which is equally likely to obtain. So it seems (1) 'If I had tossed a fair coin one million times, it might have landed heads every time' is true. But as several authors have pointed out, (2) 'If I had tossed a fair coin a million times, it wouldn't have (...) come up heads every time' will be counted as true in everyday contexts. And according to David Lewis' influential semantics for counterfactuals, (1) and (2) are contradictories. We have a puzzle. We must either (A) deny that (2) is true, (B) deny that (1) is true, or (C) deny that (1) and (2) are contradictories, thus rejecting Lewis' semantics. In this paper I discuss and criticize the proposals of David Lewis and more recently J. Robert G. Williams which solve the puzzle by taking option (B). I argue that we should opt for either (A) or (C). (shrink)

This paper is about style appropriation: the use by someone of stylistic cultural innovations distinctive of a cultural group that is not her own. While I agree with the key insight of C. Thi Nguyen and Matthew Strohl : 981-1002) – namely, that style appropriation is sometimes found objectionable because group intimacy is believed to have been breached – I disagree with their core claim that the settled beliefs of the group cannot be wrong about whether its group intimacy has, (...) in fact, been compromised in this way. I accept that facts about group intimacy can generate normative reasons concerning style appropriation, but develop a distinctive account of how this comes to be so: one which holds that such facts are independently grounded, rather than being decided by group opinion. This alternative picture of how group intimacy grounds normative reasons does better justice to the intuitive thought that reality, including its normative regions, is belief-independent. _Winner of the Fabian Dorsch ESA Essay Prize._ Julian Dodd defends the view that, in musical work-performance practice, interpretive authenticity is a more fundamental value than score compliance authenticity. According to him, compliance with a work’s score can be sacrificed in cases where it conflicts with interpretative authenticity. Stephen Davies and Andrew Kania reject this view, arguing that, if a performer intentionally departs from a work’s score, she is not properly instantiating that work and hence not producing an authentic performance (...) of it. I argue that this objection fails. A detailed analysis of work-performance practice reveals, first, that the normative scope of interpretive authenticity encompasses the practice of composing musical versions and that, second, when performers sacrifice score compliance to maximize interpretive authenticity, they are performing the target work by means of performing a version of it. By means of the nested types theory, I then show how performances produced in this way can be properly formed instances, and hence authentic performances, of their target work. (shrink)

Often those attempting to resolve the answering machine paradox appeal to Kaplan's claim that the objects of semantic evaluation are expression-types evaluated with respect to indices, instead of utterances, as part of their solution. This article argues that Dylan Dodd and Paula Sweeney exemplify the kind of mistakes theorists make in applying such expression-based semantic theories in that they conflate what is asserted with semantic content, and they take their approach to utterance interpretation as having semantic significance. In light of (...) these mistakes, we learn two things. First, we learn how expression-based semantic theorists can avoid making these kinds of mistakes. Second, we learn how the limits of expression-based semantics can contribute to what we should expect a semantic theory to explain regarding how semantics fits into a more general theory of linguistic communication and linguistic understanding. Recent financial fraud legislation such as the Dodd–Frank Act and the Sarbanes–Oxley Act (U.S. House of Representatives, Dodd-Frank Wall Street Reform and Consumer Protection Act of 2010, [H.R. 4173], 2010 ; U.S. House of Representatives, The Sarbanes–Oxley Act of 2002, Public Law 107-204 [H.R. 3763], 2002 ) relies heavily on whistleblowers for enforcement, and offers protection and incentives for whistleblowers. However, little is known about many aspects of the whistleblowing decision, especially the effects of contextual and wrongdoing attributes on organizational (...) members’ willingness to report fraud. We extend the ethics literature by experimentally investigating how the nature of the wrongdoing and the awareness of those surrounding the whistleblower can influence whistleblowing. As predicted, we find that employees are less likely to report: (1) financial statement fraud than theft; (2) immaterial than material financial statement fraud; (3) when the wrongdoer is aware that the potential whistleblower has knowledge of the fraud; and (4) when others in addition to the wrongdoer are not aware of the fraud. Our findings extend whistleblowing research in several ways. For instance, prior research provides little evidence concerning the effects of fraud type, wrongdoer awareness, and others’ awareness on whistleblowing intentions. We also provide evidence that whistleblowing settings represent an exception to the well-accepted theory of diffusion of responsibility. Our participants are professionals who represent the likely pool of potential whistleblowers in organizations. (shrink)

The number of children with chronic critical illness (CCI) is a growing population in the United States. A defining characteristic of this population is a prolonged hospital stay. Our study assessed the proportion of pediatric patients with chronic critical illness in U.S. hospitals at a specific point in time, and identified a subset of children whose hospital stay lasted for months to years. The potential harms of a prolonged hospitalization for children with CCI, which include over treatment, infection, disruption of (...) family life, and the intensive utilization of resources—combined with the moral distress experienced by the clinicians who care for the children, suggest the need for ethical analysis of this growing issue to identify actions that could be taken at the clinical and health systems levels to reduce the harms associated with prolonged hospital stay.In this article we present three real cases from our study that involved a very long hospital stay. We applied a framework developed by Mackenzie, Rogers, and Dodds to analyze inherent, situational, and pathogenic vulnerabilities to examine the ways that interventions intended to remedy one source of harm for the children in our cohort inadvertently created other harms. We examined the complex ways that children with protracted hospitalization are vulnerable to the choices made by their family and clinicians, as well as by healthcare systems and communities. Finally, we used this analysis to summarize actions and ethical responses to this growing patient population. Such an understanding is essential to making clinical and ethical decisions that arise for children who are at risk for a very long stay in the hospital. (shrink)
